What is Mediation?

Mediation is a process of resolving disputes outside of the courtroom. Participants invite a neutral third party to intervene in their dispute to help them reach agreement and reconcile their differences.

A mediator doesn't offer any comment on the merits or substance of the points in dispute. Nor do they provide an evaluation of the competing positions and claims.

Instead, by exploring the participants' interests, needs and concerns, a mediator helps them generate their own options for an agreed resolution.

Mediation is about helping parties move forward. It provides an opportunity to pause to take a fresh look and explore broader options for resolving issues.

​

Not only can mediation be used to resolve a dispute – both before and during the litigation process – but, during contract negotiations, it can help parties agree on a set of clauses so they can finally close a deal.​
